J. GORDON ARBUCKLE

Since the late 1960s, Gordon Arbuckle has been involved in the achievement of successful resolutions to high profile public policy issues in environmental contexts. He has also had a substantial energy practice including siting and continued representation of several high profile projects, such as the Louisiana Offshore Oil Port and the Trans-Alaska Oil Pipeline. He designed and developed the environmental practice for a national public policy law firm located in Washington, DC.

In the 1980s, out of concern that traditional litigation enforcement methods often proved counterproductive and that the environmental laws and regulations were becoming simply too complex to comply with in the traditional way, Arbuckle began to emphasize the management aspects of environmental compliance and risk management. At that time, he contributed some of the very early writings on Environmental Management, and began a long series of lectures, workshops and policy discussions on the subject, focused primarily on business managers and senior environmental policy makers Those dialogs resulted in an innovative approach to compliance assurance, EHS risk management and dispute resolution. The approach has been continuously upgraded to stay at the cutting edge without losing the benefits of practicality and simplicity which Mr. Arbuckle sought to foster in its conception. It has been the basis for resolution of landmark enforcement actions which have returned major benefits, in terms of major dollar savings and corporate reputation for companies and in terms of magnified and accelerated environmental and health protections for the public. Some of these resolutions have merited national attention and media coverage.

Significant compliance assurance/dispute resolution efforts have included:

  • Compliance assurance/environmental management programs for the worldwide operations of a Fortune 100 multinational agribusiness, for the US operations of a major multinational food ingredients company, for one of the largest domestic steel companies, and for the meat packing operations of a Fortune 100 agribusiness, in addition to other related projects.
  • Resolution of a national multimedia enforcement action against a major U.S.- based steel company and successful management of the multi-year compliance assurance program which was the foundation for that settlement.
  • Landmark compliance-based resolution of national prosecution of a major utility under the "New Source" provisions of the Clean Air Act.
  • Design and conduct of third party monitoring efforts to assure conformity with mandates under decrees and compliance orders.

He has provided broad policy counsel in major energy contexts such as:

  • The Trans-Alaska Oil Pipeline
  • The Louisiana Offshore Oil Port
  • The Alaska Natural Gas Pipeline
  • The first deep seabed mining license
  • LNG Operations for exporting countries
  • Integrity Management Programs
  • Responses to major incidents.

He participated on the negotiated rulemaking panel that developed the EPA Asbestos in School regulations and was lead counsel to the industry participants in the negotiated rulemaking to establish Clean Air Act standards for the wood furniture industry.

He has represented clients in administrative and judicial proceedings arising under the Clean Water Act, CERCLA, OCSLA, CZMA, CAA, RCRA, TSCA, the Endangered Species Act, and other environmental laws.

Mr. Arbuckle is an author of the Environmental Law Handbook (Government Institutes, Editions 1 - 12), the Patton Boggs Environmental Law Handbook, and the Environmental Managers' Handbook, texts widely read by environmental practitioners. He has authored numerous other articles concerning liability under environmental statutes and other developing compliance incentives.

He has received numerous awards and recognitions for his endeavors. He has been actively involved in several significant White House Initiatives including Beyond Compliance and Project XL. He also has recently participated in several significant policy deliberations, including the US EPA Innovations Task Force's report "Aiming for Excellence" and committee membership on the NACEPT Compliance Assistance Advisory Committee.
